Top trendsetting restaurants around the world

NEW YORK, Sept 6 — They're being described as the 10 most influential restaurants to launch food movements around the world.

Editors of Budget Travel magazine have come up with a list of 10 trendsetting, international eateries which have helped shape the culinary landscape by introducing diners to concepts like New Nordic cuisine, gastropub fare, and local foods.

While the list is US-heavy, with six of the 10 restaurants hailing from America, other eateries mentioned include addresses in Copenhagen, Paris and London.

The list is decidedly different from other 'best of' lists like Restaurant magazine's World's 50 Best Restaurants, which shares just one name in common — Noma in Denmark.

Here are the top 10 trendsetting restaurants according to Budget Travel magazine:

Cathay bans shark fin from cargo flights

HONG KONG, Sept 6 — Cathay Pacific said Wednesday it would no longer carry unsustainably sourced shark products on its cargo flights, dealing a blow to Hong Kong's huge shark fin industry.

Environmental groups welcomed the move but shark fin merchants said it threatened their livelihoods, even though most of the estimated 10,000 tonnes of fins Hong Kong imports annually comes by ship.

"Cathay Pacific has decided to stop shipping unsustainably sourced sharks and shark-related products," the airline said in a statement.

"There is very compelling scientific evidence to support that this is the right thing to do for a company committed to sustainability.

"Specifically, due to the vulnerable nature of sharks, their rapidly declining population, and the impacts of overfishing for their parts and products, our carriage of these is inconsistent with our commitment to sustainable development."

Hong Kong is one of the world's biggest markets for shark fins, which are used to make soup that is an expensive staple at Chinese banquets.

Environmentalists say the sustainable shark fin industry is tiny and most shark products are harvested in a way that threatens scores of shark species that are deemed vital to the health of the oceans.

WWF-Hong Kong conservation director Andy Cornish said that while it was difficult to quantify how much shark fin Cathay carried, the ban was "fantastic news".

"I think the significance of this goes beyond the direct impact of any unsustainable shark fin they might have been carrying before. This continues the momentum of companies, particularly in Hong Kong, acting more responsibly," he told AFP.

Cathay said it had studied the issue for a "very long time" before siding with conservationists who have long been calling for curbs on the shark fin trade.

"The decision had to be based on scientific data – for example, are sharks really endangered?" the airline said.

"We believe that we now have compelling evidence that the majority of shark fishing is incompatible with our position on sustainable development."

It said the new policy would take about three months to be put in place as shippers had to be notified and "appropriate procedures" established.

But no new contracts to carry unsustainably sourced shark products would be entered into, effective immediately.

Shark fin sellers condemned Cathay's decision.

"We have to put food on the table, so of course we want the shark fins to keep coming in," fin merchant Leung Wing-chiu said at his shop in an area of downtown Hong Kong where shark fins are prominently displayed for sale.

About 73 million sharks are killed every year, with Hong Kong importing about 10,000 tonnes annually for the past decade, according to environmental group WWF. Most of that is re-exported to mainland China.

The number of threatened species has soared from 15 in 1996 to more than 180 in 2010, mainly due to the growing Chinese demand for fins.

Shark fin soup is viewed by many Asians as a rare delicacy and is traditionally served at wedding parties and business banquets in Hong Kong, which handles around 50 per cent of the global fin trade.

Importers and restaurants that serve the product often cite the cultural aspect of shark fin soup to justify the trade, but some surveys suggest consumers are willing to forgo their traditional delicacy.

A survey by marine conservation group Bloom last year showed that some 78 per cent of Hong Kong respondents considered it socially acceptable to leave shark fin soup off the menu at a wedding banquet.

Major Hong Kong-based hotel chains Peninsula and Shangri-La have recently stopped serving shark fin at their up-market restaurants, amid signs that demand for the soup in Hong Kong is falling.

Cornish said however that demand in mainland China was rising due to the growth of the middle class. — AFP-Relaxnews

Venice film relives euthanasia case that split Italy

VENICE, Sept 6 — A 2009 right-to-die case that deeply split public opinion in Catholic Italy is at the centre of a new film exploring the themes of euthanasia, suicide and religious faith that is vying for top prize at the Venice festival.

"La bella addormentata", which translates as "Sleeping Beauty", is set in the final days of Eluana Englaro, a 38-year old woman who had been in a coma since a car crash 17 years earlier and became a household name in Italy when her father decided to suspend artificial nutrition.

Mixing real TV footage and fictional characters, director Marco Bellocchio recreates the heated debate that surrounded Englaro's death.

Outside the clinic where she was hospitalised, pro-life activists clashed with euthanasia supporters; while inside Parliament, lawmakers traded insults as then Prime Minister Silvio Berlusconi tried to ram through a bill that would have forced doctors to resume feeding her through a tube.

Englaro died as senators discussed the bill in a late-night session.

Against that backdrop, the film's four main characters offer their diverse and conflicting points of view on end-of-life and free will issues and the moral dilemmas they raise.

While the film is clearly more sympathetic towards secular opinions, Bellocchio said he had deliberately avoided taking a firm stance by giving voice to a variety of perspectives.

"My ideas are certainly different from those of some of the characters in the film, but I can find something to relate to in all of them," he said after a press screening in Venice.

"I have no faith, but I respect those who do, and look at them with curiosity and interest."

He said he had spoken about the film with Eluana's father, Beppino Englaro, who battled his way through Italian courts for a decade to have her feeding tube removed, becoming a symbol for right-to-die advocates.

"He did not raise any objections. I know he has seen it, but I don't want to say anything about what he thinks of it," Bellocchio said.

Veteran Italian actor Toni Servillo plays a senator from Berlusconi's centre-right party torn between political loyalty and personal convictions, and also struggling to find common ground with his daughter, a Catholic pro-life activist.

Isabelle Huppert is cast as the Divine Mother, a famous actress who turns to religion in the hope of reawakening her own daughter from a vegetative state. And a drug-addict sees her attempts to take her own life repeatedly thwarted by a young doctor.

"Ultimately, the question asked by the film is that we want to be free to choose but then what do we do with that freedom once we have it," said Huppert.

"No one can answer that and we did not have an answer when shooting it."

Stars, politics set to stir up Toronto film festival

NEW YORK, Sept 6 — A strong film line-up full of politically charged themes and a heavy dose of Hollywood stars have raised high hopes the Toronto International Film Festival, set to open today, will breed Oscar contenders, rapturous audiences and plenty of film deals.

Considered one of the world's top festivals, Toronto serves as a kick-off to Hollywood's awards season, and will screen more than 280 films over 11 days.

Stars turning out to showcase or support films including Ben Affleck, Johnny Depp, Ryan Gosling and Kristen Stewart.

The festival has previously unearthed films that go on to success at the Academy Awards, such as "Slumdog Millionaire" and "The King's Speech", which both won best-film Oscars.

"It's going to be one of the strongest years ever, not just for the pictures we are bringing, but so many unsold pictures that are there with major directors and major names," said festival regular Michael Barker of Sony Pictures Classics.

"This is a contest where you want people to see your film," he added, noting that festival founded in 1976 had forged a reputation for guaranteeing filmmakers media attention, friendly audiences and quality movies.

Political thriller "Argo", directed and starring Ben Affleck and premiering tomorrow, is one of several bigger titles hoping to pave the way for later awards success.

The story, based on how the CIA smuggled six Americans out of Iran under the cover of a Hollywood film production during the 1979 hostage crisis, is one of several politically themed films, said the festival's co-director Cameron Bailey.

"A lot of films are dealing with the intersect of political and social conflict," Bailey said, also citing "The Reluctant Fundamentalist" about a young Asian man coping on Wall Street after the 9/11 attacks, and several documentaries including "Camp 14: Total Control Zone" about a man's escape from a labour camp in North Korea.

Adding to the political atmosphere, Palestinian National Authority Prime Minister Salam Fayyad is scheduled to appear at a press conference on Sept 11 to talk about the film "State 194", which follows his efforts to gain United Nations recognition for his country as an independent state.

Another film examining the Middle East conflict, "The Gatekeepers", is a documentary that tells the inside story of Israel's Shin Bet security agency. It has already gained critical buzz coming out of the Telluride film festival.

Bailey noted many of the films tackling political issues were often years removed from the event and posed "more complex questions that come after a political conflict or tough social situation — it's not just about the moment, but living with what happens afterwards".

Oscar contenders

But away from politics, stars expected to add glamour on the red carpet are Nicole Kidman, Ewan McGregor, Bradley Cooper, Tom Hanks, Halle Berry, Marion Cotillard and Selena Gomez.

"Twilight Saga" actress Kristen Stewart is expected to make her first official appearance since her public admission to cheating on boyfriend Robert Pattinson and will hit the red carpet for her movie "On The Road" today, the same night the festival officially kicks off with time-travel thriller "Looper".

And Johnny Depp is due to appear to help promote the documentary "West of Memphis" about the case of the West Memphis 3 murderers first screened earlier in the year.

Among Oscar hopefuls, critics and audiences will weigh in on Paul Thomas Anderson's "The Master" starring Philip Seymour Hoffman as a cult leader and Joaquin Phoenix as his tortured protégé. It already gained high praise at the Venice Film Festival.

Other highly anticipated films include "Cloud Atlas", an adaptation of the best-selling novel starring Hanks and Halle Berry, as well as David O. Russell's "Silver Linings Playbook" starring Bradley Cooper, Jennifer Lawrence and Robert De Niro.

Performances being watched for possible later awards success will include Bill Murray's already buzzed-about turn as US President Franklin D. Roosevelt in "Hyde Park on Hudson" and Marion Cotillard as a marine worker who loses her legs in an accident in "Rust & Bone".

Actor Dustin Hoffman will make his directorial debut in the comedy "Quartet" and Robert Redford will show his "The Company You Keep".

In addition — from "The Reluctant Fundamentalist" to Salman Rushdie's "Midnight's Children" and "Anna Karenina" starring Keira Knightley — there will be more literary adaptations this year than usual.

On the business end, movies ranging from "At Any Price" starring Zac Efron, to Terrence Malick's "To The Wonder", are due to arrive without distributors among dozens of films looking to get sold.

Barker predicted there would be brisk business at the festival, "however because of the nervousness in the marketplace about whether they will make money or not, they probably will not be sold for the money that the sellers want." — Reuters

US study links household chemical with heart disease

NEW YORK, Sept 6 — A chemical known as PFOA, found in common household products, may be linked with heart disease and stroke, according to new research published online on Sept 3.

"Even at the low exposure levels of PFOAs found in most Americans, there is a positive association between increasing levels of PFOAs and cardiovascular disease," researcher Anoop Shankar of the West Virginia University School of Public Health in the US told WebMD.

PFOA is widely used to make lubricants, polishes, paper coatings, food packaging, fire-retardant foams, and products made with Teflon.

Levels of this chemical have been found in the blood of more than 98 per cent of Americans, and the chemical stays in the body for years.

Appearing in the journal Archives of Internal Medicine, the research involved data on more than 1,200 men and women, averaging in their 50s, gathered from the National Health and Nutrition Examination Survey.

According to CNN, subjects "with the highest levels of PFOA in their blood had double the odds of having a history of heart disease, heart attack, or stroke, compared to adults with the lowest PFOA levels".

Also, those subjects with the highest levels of the chemical in their blood were associated with 78 per cent greater chances of peripheral artery disease.

But because the research only found an association between PFOA and vascular diseases, not a cause-and-effect link, the scientists say more work needs to be done.

WebMD reports that while other studies have found a link between PFOA and heart disease risk factors, such as high blood pressure, few studies have examined the chemical's effects on cardiovascular disease, such as heart attack and stroke. — AFP-Relaxnews

Interactive gravestones link to online tales of life

LONDON, Sept 6 — Summing up the life of a dearly departed relative with just a terse description etched in stone may become a thing of the past with the introduction of interactive codes on gravestones.

One funeral company in the southern English town of Poole is offering to add quick response (QR) codes to headstones which will link smartphones to online memorials illustrated with pictures, videos and contributions from family and friends.

Chester Pearce Funeral Directors said QR barcodes enable visitors to learn a lot more about the person buried beneath gravestones than the age, dates of birth and death and the odd biblical passage or literary quote usually written on them.

"It's about keeping people's memories alive in different ways," said managing director Stephen Nimmo.

"When you lose somebody, whether it be suddenly or ongoing, you can really struggle with things.

"Talking about them is very important, keeping their memory going is very important and this is just an add-on to that."

QR codes, a barcode that can be scanned with smartphones or QR scanners, allow users to pull up information on the internet and are frequently used in advertising and marketing campaigns.

"It's a new technology, it's something that there will be people who like it, there will be people who don't and that's the same in everything that we do," Nimmo said.

He said he has seen demand growing for QR codes as they catch the imagination of the public.

Chester Pearce charge about £300 (RM1,500) to create a code that can also be placed on gravestones, benches, trees or plaques and is linked to a page on their QR Memories website.

Gill Tuttiet, 53, was one of the first customers in Poole to use the technology for her late husband Timothy.

"Tim was quite outward-going and game for anything. I think this is the way forward and Tim would have wanted that, and it's making a process that's hard possibly easier," Tuttiet said.

The website linked to the code shows a profile of the departed, pictures, videos and tributes from family and friends.

Close friends and family given a password are also able to add personal messages of their own.

Olympic gold medalist Gabby Douglas to pen memoir

NEW YORK, Sept 6 — Sixteen-year-old Olympic gold medallist Gabby Douglas plans to write an "inspirational memoir" that will be published later this year, People Magazine said today.

Douglas made history in London at the 2012 Summer Olympics when she became the first African-American to win the gold medal in the all-round individual gymnastics competition.

"Even before I competed in the Olympics, I always wanted to write a book," Douglas told the magazine, adding it will detail how much she and her family overcame to achieve her Olympic dream.

Douglas, who took home two Olympic gold medals, left her family in Virginia when she was 12 years old to train with a new coach in Iowa.

The book, Grace, Gold and Glory, My Leap of Faith, will be published by the Zondervan division of HarperCollins in December.

"Gabby Douglas shines even more brightly than her Olympic Gold Medals. The reason is her inner strength and strong faith," Lisa Sharkey, Harper's vice president said in a statement. — Reuters


Muslim Arab-American Green Lantern adds diversity to superheroes

NEW YORK, Sept 6 — DC Comics introduced a new Green Lantern yesterday — a Muslim from Dearborn, Michigan, who leaves behind street racing to join an intergalactic police force.

Simon Baz — the muscular protagonist in his early 20s with the Arabic word for courage "al-shuja'a" tattooed on his arm — is the latest example of superhero diversity in the comic book world. His debut comes after DC Comics unveiled a gay Green Lantern in June and Marvel Comics presented a half-black, half-Latino Spider-Man last year.

"In typical comic books, there's a big handsome white guy and that's it. But that's not the world we live in and comics are reflecting that," said Thor Parker, social marketing and event director at Midtown Comics in New York. Parker's store was selling the new comic book yesterday.

Most comic book fans know the Green Lantern's alter ego as Hal Jordan, who is Caucasian, a ladies' man who was played by Ryan Reynolds in the 2011 film.

But GREEN LANTERN #0, released yesterday, tells the story of Baz, an American of Arab ancestry raised in a Muslim family. He is chosen to be part of the Green Lantern Corps, an intergalactic police force.

The original Green Lantern was introduced in 1940 with a character named Alan Scott. DC revived the Green Lantern in 1959 with Jordan.

The new story begins with Baz as a child watching television images of a burning World Trade Centre on September 11, 2001, according to a copy of the comic book viewed by Reuters.

As an adult, Baz, with a criminal record for illegal street racing, turns to car theft after he loses his job at an automobile factory. A car he tries to steal lands him in the middle of a terrorism investigation.

Later on, he is magically bestowed with a ring that gives him super powers and anoints him a Green Lantern.

Geoff Johns, who writes the Green Lantern series, said Baz's character was part of an effort to diversify the universe of superheroes.

"There's no real prominent Arab-American superheroes in DC (Comics) at all," said Johns, adding that Baz's background also dovetailed with the superhero's story.

"You are chosen to become a Green Lantern because you are of the ability to overcome great fear, and I thought that would be a great (theme) to play with, with a character of this background," he said.

GREEN LANTERN #0 is part of a collection released in September that tells the back story of famous DC Comics characters. Baz will be the focus of several more comic books, Johns said, but he declined to say for how long.

The next Green Lantern comic book, in which Baz will be the focus, will be released in October. — Reuters

KUALA LUMPUR, 6 Sept — Tun Dr Mahathir Mohamad hari ini memberi amaran kepada rakyat di negara ini agar tidak memilih Pakatan Rakyat (PR) dalam pilihan raya akan datang kerana mereka tidak akan berupaya untuk berubah kepada Barisan Nasional (BN) semula apabila PR telah memerintah.

Jelas mantan perdana menteri itu lagi,  pilihan untuk "merubah pemimpin" itu juga bukanlah satu tindakan yang baik, sebaliknya mengingatkan berkemungkinan ia langkah yang amat teruk.

"Ada yang kata kita tukarlah (pemimpin) ... cuba yang lain ... kita cuba lima tahun, kalau tidak baik, kita tukar.

"Sekali mereka berkuasa, mereka akan buat untuk rakyat tidak boleh bertukar lagi kepada BN," kata Dr Mahathir (gamber) ketika program sepetang bersama beliau di Pusat Komuniti Bukit Bandaraya anjuran Kelab Pesara Kerajaan Lembah Pantai di sini.

Jelas beliau yang telah berkhidmat selama 22 tahun sebagai perdana menteri, usaha mengubah pemimpin negara itu juga berkemungkinan akan menghancurkan negara ini jika kita hanya memilih mereka yang hanya "ingin menjadi perdana menteri."

"Jika kita menghargai keamanan dan kemakmuran yang kita ada, kita pasti akan dapat lebih lagi daripada pembangunan," kata Dr Mahathir lagi.

Peguam sedia bantu pelajar dibuang kolej buat rayuan

KUALA LUMPUR, 6 Sept — Peguam parti DAP, Eric Tan menggesa pelajar yang dibuang kolej, Muhammad Ammar A. Rahman untuk membuat rayuan di mahkamah selepas insiden menunjukkan punggung kepada potret perdana menteri (PM) Datuk Seri Najib Razak pada malam ambang Kemerdekaan tempoh hari.

Eric berkata dalam satu sidang akhbar di ibu pejabat DAP, bagi memberikan penjelasan ke atas penahanan dua lagi individu yang ditahan polis bagi membantu siasatan kes memijak potret PM.

"Saya sangat berharap pelajar kolej yang dibuang daripada Kolej Teknologi Antarabangsa Cybernatics tersebut menimbangkan untuk membuat rayuan di mahkamah bagi menarik balik keputusan tersebut.

"Kami sedia membantu dia dan memberikan khidmat guaman kepada pelajar tersebut," kata Eric.

Muhammad telah dibuang kolej tanpa diberi peluang untuk membela diri atau memberi penjelasan, malahan pelajar berusia 19 tahun tersebut tiada sebarang masalah disiplin, akademik serta bergiat aktif dalam aktiviti kokurikulum di kolej.

Malahan pihak pengurusan kolej dalam kenyataan kepada TV3 semalam juga menegaskan keputusan tersebut adalah muktamad dan sebarang rayuan tidak boleh dikemukakan.

Eric selaku wakil peguam nasihat kepada Ong Sing Yee, 19 dan Lim Kian Peng, 20 yang ditahan di Johor dan kemudiaan dibawa ke Kuala Lumpur semalam juga mempersoalkan tiga perkara mengenai penahanan kedua-dua individu tersebut oleh pihak polis bagi membantu siasatan.

Kedua-dua individu tersebut tiba di IPD Dang Wangi dari Johor pada 10 malam dan dibebaskan dengan jaminan polis pada pukul 2 pagi hari ini selepas keterangan selesai rekod.

Timbalan ketua polis daerah Johor Baharu Selatan, Abdul Samad Salleh dalam kenyataan kepada Utusan menyatakan Ong dikehendaki polis berhubung satu laporan yang disiasat mengikut Seksyen 4 (1)(b) Akta Hasutan 1948, Seksyen 290, 504 dan 509 Kanun Keseksaan.

"Perkara pertama yang sama ingin persoalkan ialah kenapa dia digari seperti seorang penjenayah dan mengapa dibawa dari Johor ke KL semata-mata untuk mengambil keterangan. Bukankah keterangan tersebut boleh saja diambil di Johor?.

"Perkara kedua pula mengapa pihak polis bersikap berat sebelah dalam isu ini dan mengapa dia disiasat dibawah Akta Hasutan?

"Kalau benar itu akta yang boleh digunakan untuk mendakwa orang yang memijak gambar, kenapa polis tidak ambil tindakan sama kepada mereka yang pijak potret Lim Guan Eng dan menteri besar (MB) Kelantan?.

"Yang ketiga, kenapa mereka dipaksa menandatangani keterangan tanpa diberi penjelasan tentang keterangan tersebut?," katanya lagi.

Ong semasa ditanya mengenai layanan pihak polis semasa diambil keterangan menyifatkan dua pegawai polis yang menemubualnya bersikap profesional dan banyak bertimbang rasa semasa sesi keterangan tersebut.

"Polis bersikap profesional dan banyak memberikan kerjasama semasa keterangan diambil.

"Saya juga ingin meminta maaf kepada semua orang ke atas tindakan tersebut dan ia dilakukan buat dengan berniat.

"Saya hanya melakukannya secara suka-suka tanpa diarahkan mana-mana pihak," kata Ong.

Eric yang mewakili kedua-dua individu tersebut juga menambah dengan meminta maaf kepada PM ke atas perbuatan Ong dan Lim tersebut sambil mengganggap ia bukan bertujuan untuk memalukan.

Dalam kejadian malam 30 Ogos lalu, Muhammad serta beberapa individu peserta perhimpunan Janji Bersih menghina potret PM dan isteri dengan memijak selain mengibar bendera "Sang Saka", sejak daripada insiden tersebut polis telah menubuhkan tiga pasukan khas untuk melakukan siasatan.

Preventing the next Lynas or Raub mine

SEPT 6 — Communities around Malaysia have been protesting over development projects such as the Raub gold mine, the RAPID Pengerang refinery, the Lynas rare earth plant, dams in Sarawak, the MRT, and the Kuala Lumpur Outer Ring Road (KLORR).

At the heart of their disgruntlement are fears over the health and environmental impact of the projects, and the potential loss of their homes or livelihood.

Most of these projects have been passed without much knowledge of local residents. The technical nature of the dangers posed by such projects is often difficult for communities to comprehend quickly without the help of sympathetic experts.

They are initiatives that appear to have been settled at a higher level between developers and government.

The often poor communities near these projects usually lack the power and finances to roll back such projects once they are started, although it would be a mistake to underestimate the power of sustained organising and campaigning to change things.

It will be tough to resolve these existing cases in a manner that reconciles industrial interests, political patronage, and the rights of communities or nature. The scientific "facts" of the dangers invariably become highly politicised.

However, there is a relatively simple solution that could help prevent such disputes from arising in the future.

The Environmental Quality Act 1974 requires an Environmental Impact Assessment (EIA) to be produced when projects of a certain class or scale are proposed.

The EIA is supposed to be a measure that acts to prevent destructive projects, or at least mitigate any harmful aspects. Although focused on environmental factors, it includes social assessment, including some obligation to consult with affected communities.

There are two major problems with the present EIA process.

One is the independence of EIA consultants, the second is the weak role given to community consultation and approval.

1. Shift full responsibility for EIA process to DOE

Currently, the Department of Environment (DOE) requires developers to submit the EIA report. This report is funded by the developers, therefore its independence and objectivity is compromised.

Consultants who don't produce a report that ultimately favours the project will find themselves passed over in favour of consultants who can more reliably produce positive recommendations.

A better solution would be to require the DOE to have the responsibility of conducting the EIA. Developers would pay assessment costs into a blind fund administered by the DOE.

In this case, technical experts and consultants engaged by the DOE would have a fiduciary duty to the DOE and, by extension, to the public interest, rather than a private developer.

This is the method taken in the US by its Environmental Protection Agency. Now, just because this happens in the US doesn't necessarily make it an impeccable idea, but from the standpoint of independence and integrity of technical advice, it is clearly better than our present system.

Government agencies can still be captured by private interests, but they will still have to reconcile that with their formal duty to the public interest.

2. Implement free, prior and informed consent (FPIC) as part of development process

Development that happens without consultation is oppressive to communities. Discovering one fine day that there is highway about to plough its way through your house is upsetting.

Having your development project picketed, protested and pilloried in public is also a weight on developers. But that's what happens when you don't consult sufficiently with local people. That's what happens when you think it is sufficient to secure "buy-in" at the political level in order to carry out your project.

Free, prior and informed consent (FPIC) is an approach outlined in international human rights law and declarations. It essentially upholds the right for project-affected peoples to be consulted by, and to negotiate with, project developers on the impact of a project on their community. Greater weight should be accorded to a community's right to say "No" to a project.

At its heart is the idea that the pre-existing moral and property rights of residents should balance the privileges granted to the yet-to-be-constructed property of a private developer.

Instituting such rights within the EQA, or within an equivalent law, will not mean the end of development in Malaysia. It will mean that development planning will not be something that can simply be imposed from "on high", rather it must be negotiated with affected peoples.

Implementing these two reforms would go far in improving the integrity and credibility of the EIA process and preventing, or at least reducing, instances where development projects are "sprung" on communities, which leads to campaigns, lawsuits and political problems.

Communities can feel much more secure in their rights to property, health, and a clean environment.

Developers should have greater confidence that their projects can proceed without significant interruption, delay or reputation problems following adequate consultation.

We all know democracy has great room for improvement in Malaysia, but it is strengthening as expectations grow. Granting greater rights to project-affected peoples and communities is consistent with the democratisation of the economy that Malaysians deserve.

Sejarah Merdeka wajib ditulis semula

6 SEPT — Sudah menjadi trend, menjelang sambutan ulangtahun Merdeka, akan timbul isu menimbulkan polemik sehingga menyebabkan kita berfikir semula apakah kita hidup dalam sebuah negara yang begitu "banal" dan masih belum selesai perkara asas sebagai sebuah negara bangsa.

Heboh seluruh negara apabila media arus perdana memainkan gambar beberapa anak-anak muda mengibarkan bendera "Sang Saka Malaya" — mirip bendera Singapura, Indonesia, Umno dan PAS.

Tindakan ini dianggap satu pengkhianatan kepada Jalur Gemilang sebagai bendera rasmi negara, lambat laun, pasti anak-anak muda tersebut ditangkap polis untuk siasatan.

Heboh juga apabila terdapat beberapa anak-anak muda memijak gambar perdana menteri, Datuk Seri Najib Razak dan isterinya, Datin Seri Rosmah Mansor.

Tidak terlepas, gambar pengerusi Suruhanjaya Pilihan Raya (SPR), Tan Sri Abdul Aziz Mohd Yusof turut menjadi mangsa.

Tahun lalu, timbalan presiden PAS, Mohamad Sabu dikecam diseluruh negara selepas memuji tindakan berani Mat Indera dalam melawan penjajahan kolonial Inggeris.

Media arus perdana memainkan tentang Mohamad yang dianggap menghina pejuang Bukit Kepong dan menyokong komunis.

Akhirnya, kerajaan Barisan Nasional (BN) kembali terperangkap apabila terdapat sebuah buku terbitan sebuah yayasan di Johor yang mana Menteri Besar Datuk Abdul Ghani Othman sendiri menulis kata pengantar, memuji tindakan berani Mat Indera dalam melawan penjajah British.

Kebenaran pasti muncul

Realiti hari ini, Jalur Gemilang adalah bendera yang diterima oleh majoriti rakyat Malaysia.

Seperti yang dikatakan oleh pakar sejarah Prof Emeritus Tan Sri Khoo Kay Kim baru-baru ini bendera sesuatu negara diputuskan oleh majoriti rakyat sesuatu negara tersebut.

"Kalau majoriti rakyat nak tukar bendera, bolehlah tukar.

"Kalau tidak kita guna sahaja yang sedia ada," kata beliau seperti yang dilaporkan oleh The Malaysian Insider baru-baru ini.

Internet telah menyebabkan maklumat yang disorokkan daripada pengetahuan umum sebelum ini, terbongkar dan apabila dimainkan oleh media arus perdana bolehlah kita ibaratkan sebagai "senjata makan tuan".

Saya tertawa apabila membaca komen-komen di laman sosial Twitter oleh penyokong Umno yang mencerca anak-anak muda yang mengibarkan Sang Saka Malaya dengan mengatakan bendera tersebut menyerupai bendera Singapura.

Mungkin mereka terlalu naif dengan sejarah serta tidak mempunyai inisiatif untuk membaca atau menggali maklumat dalam internet tentang sejarah bendera Umno itu sendiri.

"Sang Saka adalah sejarah bangsa, dari zaman kerajaan Langsakuka, Gangga Negara, Sri Vijaya inilah warnanya.

"Merah putih adalah motif nusantara.

"Motif Melayu Raya, kerana itu bendera Umno, PAS, Singapura dan Indonesia semuanya menggunakan Sang Saka," kata Hishamuddin Rais dalam laporan The Malaysian Insider beberapa hari lalu.

Penulisan semula sejarah

Buku teks sejarah perlu menulis semua perkara yang berlaku tanpa memihak kepada mana-mana parti politik.

Walaupun sedikit sebanyak ia akan mengguris hati sesetengah pihak, namun kebenaran tetap perlu ditulis.

Keluarga kepada askar-askar Melayu yang berkhidmat dengan penjajah Inggeris perlu tahu bahawa apa yang dilawan oleh ayah, pakcik atau abang meraka dalam askar Melayu pada ketika itu adalah pejuang-pejuang kemerdekaan yang terpaksa masuk ke hutan menyertai Parti Komunis Malaya (PKM) selepas darurat diisytiharkan oleh penjajah.

Darurat datang bersama dengan pengharaman parti-parti politik progresif seperti PKMM, PKM, Hizbul Muslimin dan banyak lagi.

Penjajah begitu takut dengan gabungan Putera-AMCJA selepas "hartal" (sejenis protes politik) dilancarkan diseluruh negara pada 20 Oktober 1947 mendapat sambutan besar dari rakyat.

Protes politik pertama yang terbesar bagi rakyat Malaya pelbagai kaum.

Jika anda mempunyai masa, tontonlah dokumentari bertajuk "Sepuluh Tahun Sebelum Merdeka" arahan Fahmi Reza yang boleh ditonton dari laman YouTube.

Dokumentari ini menceritakan dengan jelas tentang apa yang berlaku sepuluh tahun sebelum British menyerahkan Malaya kepada Umno, MCA dan MIC.

Dokumentari tersebut memperlihatkan dengan jelas bagaimana penjajah British menggunakan media untuk melaga-lagakan masyarakat Melayu, Cina dan India yang sebelum itu tidak kenal erti politik perkauman.

Untuk terus maju kedepan, kita perlu selesaikan perkara asas.

Selagi kita tidak melakukannya, kita akan terus tersekat dengan perkara-perkara warisan penjajah seperti politik perkauman yang menghalang Malaysia untuk terus maju kedepan.

Sejarah juga tidak akan melupakan jasa Umno dan Barisan Nasional yang telah memimpin Malaysia sehingga apa yang dicapai hari ini.

Patriotisme akan muncul jika rakyat tidak ditipu oleh sejarah yang ditulis oleh golongan yang menang.

Pembodohan terbesar dalam penulisan sejarah hari ini adalah Malaya mendapatkan kemerdekaan tanpa menumpahkan setitis darah walaupun sebenarnya ribuan telah mati dibunuh untuk kemerdekaan tanah air.

Adillah kepada sejarah yang berlaku dan Malaysia akan maju kedepan dan akan memimpin Asia Tenggara dalam menghadapi persaingan global.
