FIFA suspends Barcelona transfer ban

FIFA today suspended a ban on Barcelona signing players while the club makes an appeal against a 14-month transfer ban.

World football's governing body, which imposed the sanction this month for breaching rules on the registration of minors, announced in a statement that the ban would be temporarily suspended allowing Barcelona to sign players during the summer transfer window which opens on July 1.

The club welcomed the move.

"FC Barcelona sees the decision announced today by the FIFA Appeal Committee to provisionally allow the cautionary measures requested in the club's appeal against the sanction imposed by FIFA's Disciplinary Committee as a positive step," the club said in a statement.

The Spanish champions are in desperate need of an overhaul in the summer transfer window after a difficult season which is likely to see them miss out on a major trophy for the first time in six years.

Replacements are primarily needed for goalkeeper Victor Valdes and club captain Carles Puyol who have both announced their intention to leave the club at the end of the current campaign.

Barcelona has appealed against what would be a dramatic restriction on its operations and asked for the sanction to be suspended, the FIFA statement said.

FIFA Appeal Committee chairman Larry Mussenden agreed that the appeal meant the ban should be suspended.

Mussenden "took into consideration the sanctions imposed against the club, the complexity of the matter, the start date of the next registration period – July 1 – and the fact that the FIFA Appeal Committee does not seem in a position to take a decision on the main issue early enough so that an eventual appeal of the club against its decision before the Court of Arbitration for Sport would still be decided before the beginning of the next registration period," said FIFA.

Mussenden "assures that proper and adequate appeal proceedings will take place and, at the same time, that all rights of the club will be respected".

FIFA's disciplinary committee imposed the transfer ban on April 2 after finding Barcelona guilty of "serious" breaches of rules on under-age players.

It also fined the Spanish Football Association or allowing the deals.

The Spanish champions were given 90 days to regularise the situation of 10 minor players.

Barcelona president Josep Maria Bartomeu described the ban as a "grave injustice" and insisted the club intend to make moves in the transfer market this summer.

There are two transfer windows in the 14 month ban, one starting in July and running to the start of the new Spanish season. The second would be in January 2015.

In 2010, FIFA imposed a similar transfer window ban against Chelsea over the signing of French youngster Gael Kakuta. It was overturned after Chelsea reached an agreement with the player's former club Lens. – AFP, April 23, 2014.

Ferrer suffers early defeat in Barcelona

Four-time finalist David Ferrer (pic) crashed out in the second round of the Barcelona Open today, producing a rusty performance to lose 6-4 6-2 to Georgia's Teymuraz Gabashvili.

The world number five, who beat fellow Spaniard Rafa Nadal en route to the semi-finals of the Monte Carlo Masters last week, was a long way from his best against a player 50 players below him on the ATP rankings.

Gabashvili made precious few mistakes, breaking the second seed four times on his way to victory.

"This was one of my best victories, no in fact it is my best ever, beating David Ferrer," the Russian told reporters.

"I went into the game knowing that I had to be steady and controlled which is what I managed to do."

Gabashvili raced into a 3-0 lead in the first set but it appeared as though Ferrer was back on track when he levelled at 3-3. Ferrer, continued to make unforced errors though, and once he went a set behind he looked dispirited.

Third seed Fabio Fognini from Italy also bowed out with a whimper, trailing 6-0 4-0 to Colombian Santiago Giraldo when he retired from the second round match.

Nadal has dominated the Barcelona Open in recent years having won eight out of the last nine tournaments.

He is in action against fellow Spaniard Albert Ramos in the second round today. – Reuters, April 23, 2014.

Oscar winner Lupita Nyong’o named People’s most beautiful woman

It's been a big year for Lupita Nyong'o (pic). After winning an Oscar and a lucrative advertising deal the actress was named as the world's most beautiful woman for 2014 by People magazine today.

Nyong'o, who took home this year's Academy Award for best supporting actress for her role as the slave Patsey in director Steve McQueen's acclaimed film "12 Years A Slave," said she "never dreamed" she would be praised for her looks and land on the cover of the weekly magazine.

"It is exciting and just a major, major compliment," Nyong'o, 31, told People. "I was happy for all the girls who would see me on it and feel a little more seen."

Although the Mexican-born actress who grew up in Kenya first equated beauty with television images of light skin and long straight hair, Nyong'o said her mother always told her she was beautiful.

"And I finally believed her at some point," she added.

This year's most beautiful people list also includes actresses Keri Russell, Jenna Dewan-Tatum, Mindy Kaling and Amber Heard. Pop singer Pink, actresses Gabrielle Union, Molly Sims and Kerry Washington, and model and former professional wrestler Stacy Keibler also made annual ranking.

In addition to her acting talents Nyong'o, a graduate from the Yale School of Drama, has won praise for her distinctive style on the red carpet and was named as the new face of the French cosmetics and skincare company Lancome Paris. – Reuters, April 23, 2014.

The troubled Canadian pop prince posted a snap of him at Yasakuni shrine on his Instagram account – tweeting the link to his 51 million Twitter followers – with the message "Thank you for your blessings".

The shrine is seen across Asia as a symbol of Japan's perceived lack of penitence for its imperialist past.

An attached museum peddles a view of World War II deemed unpalatable by most mainstream historians, casting Japan as a victim and a frustrated liberator of Asia.

A storm erupted across social media after the posting, with fans lambasting the 20-year-old star for historical ignorance, and even China's foreign ministry suggesting the young singer should educate himself on the issue.

As the story gained traction and was picked up by mainstream media, the picture was removed. Around 13 hours after the original tweet, Bieber issued a mea culpa on his Instagram feed.

"While in Japan I asked my driver to pull over for which I saw a beautiful shrine. I was mislead to think the shrines were only a place of prayer. To anyone I have offended I am extremely sorry. I love you China and I love you Japan."

The apology came after irate users flooded social media networks with complaints.

"Hey Justin, do u even know where that is?" wrote Instagram user vivien_kong.

On Sina Weibo, often called China's Twitter, one user wrote: "I would like to scold him and beat him like a child"

"China should ban Bieber, that would be a sensible decision," wrote another.

Chinese foreign ministry spokesman Qin Gang, speaking at a regular briefing today, said he had not been aware of Bieber's visit to the shrine.

But he added: "I hope that this Canadian singer after visiting the Yasukuni shrine can have a clear understanding of Japan's history of invasion and militarism, and of the source of Japan's militarism."

The backlash recalls Bieber's visit to the Anne Frank museum in Amsterdam a year ago, when he sparked a furore with a message in the guest book at the house of the Jewish teenager, who died in a World War II concentration camp.

"Truly inspiring to be able to come here. Anne was a great girl. Hopefully she would have been a belieber," he wrote.

"Beliebers" are the nickname given to the singer's legions of fans, many of whom are pre-teen girls.

The Anne Frank museum defended the teen idol over the row, expressing gratitude that he had taken time to visit, but the comment caused uproar.

The once squeaky-clean Canadian has run into repeated trouble in recent times and is facing possible deportation from the US in connection with an alleged drag racing incident.

Bieber also faces an assault charge in Canada for allegedly striking a limousine driver on the back of the head.

Wednesday's episode came hours before US President Barack Obama arrives in Tokyo at the start of a four-country Asian tour.

On Tuesday nearly 150 Japanese lawmakers paid homage at Yasukuni, sparking protests from China, which said an offering earlier in the week by Prime Minister Shinzo Abe was "a slap in the face" for Obama. – AFP, April 23, 2014.

Study offers hope for survival of island nations as sea levels rise

Some of the world's smallest nations might survive rising sea levels brought about by climate change but in different forms as their atoll islands grow and change, according to a New Zealand research.

Pacific island atolls might in fact be getting larger or remaining stable in their size as new gravel and sand is carried by waves from their coral reefs to shore, said Professor Paul Kench, head of the University of Auckland's School of Environment which is conducting the study.

Tiny island nations, such as Tuvalu and Kiribati, had been thought to be among the most vulnerable to rising sea levels but the study has shown very few islands shrinking in size, Kench told Xinhua news agency yesterday.

Researchers were building a dataset of changes over the past 50 years to 1,000 islands in the Pacific, and now had more than 500 examples.

Most of them, like Tuvalu, had either remained stable or grown, while some had been moving on their reef surfaces.

"We can't as yet determine whether some island groups are more susceptible or sensitive to change than others. However, this is something we believe we should be able to identify as the larger dataset develops," said Kench.

Some of the islands could hold relatively large populations, such as the more densely populated islands including South Tarawa on Kiribati, where at least 20,000 people lived, and Fongafale, Tuvalu, which was home to about 5,000 people.

"However, these are the urban capitals. There are many islands with small communities of 100 to 800 people. There are still many more islands with no one currently living on them," said the professor.

The least populated and least developed islands were likely to be more robust against rising sea levels than the bigger population centres.

"At some densely populated sites pollution may have reduced reef health and sediment production is diminished. The best mitigation measure that communities could engage in would be to maintain reef health," Kench said.

"It is possible that some islands may eventually have to be abandoned. However, this should not mean all islands in a nation will disappear.

"There are some large and uninhabited islands in most small nations that could be used to establish new settlements in the future. This infers that there may need to be some migration within a country," the professor said.

Vegetation could colonise newly accreted land very quickly, but the Pacific had many examples of people living on islands with a lack of vegetation.

However, urgent research is needed into whether water resources would change and communities would still be able to grow food crops such as taro.

More research is also needed into ocean acidification, another side-effect of climate change, and the impact this would have on the ability of reefs to generate fresh sand and gravel to build islands.

"It is possible that it might compromise the ability to generate fresh sand and gravel supplies from surrounding reefs," said Kench.

"However, others suggest that weaker skeletons of corals and other organisms might lead to a pulse of new sediment available for island building. There simply hasn't been sufficient research undertaken to resolve this question," he added. – Bernama, April 23, 2014. 

Cubans get Hollywood, football fix through ‘paquete’

Hungry for the Internet and barred from access to satellite television, Cubans have regularly swapped entertainment stored on USB sticks or computer hard drives.

The practice has now evolved to a sophisticated new level, however, with the rise of what is known locally as the "paquete".

Each week, a new such paquete arrives, and Cubans guided by word of mouth hurry to fill USB keys with hours of high-end entertainment at prices ranging from less than a dollar to five dollars, depending on the content, which is available a la carte.

It might be a pirated Hollywood movie or a chance to watch Cristiano Ronaldo and Lionel Messi in the latest action from Spain's La Liga football championship.

Others favour the latest episodes of racy Brazilian or South Korean soap operas, hugely popular in Cuba.

For the underground distributors of paquetes, these bundles of digital escapism are nothing more than harmless fun.

"There's no politics, no pornography, nothing for the police to get worried about," says one distributor, Jose.

Authorities in Cuba have so far largely turned a blind eye to the phenomenon.

A notable exception, however, is former culture minister Abel Prieto, a special adviser to President Raul Castro, who recently decried the "trashcan of the paquete", which he said was a symptom of "Yankee culture invading us shamelessly".

Addressing a meeting of intellectuals in mid-April, Prieto said it was time to "oppose, tear down and depreciate the paquete... so that people understand they are being fooled." But he pointedly failed to recommend an outright ban on the paquete.

At the same meeting, meanwhile, an official commission acknowledged that Cuba's five state broadcast channels were "very distant from the cultural, informational and entertainment needs of our people".

Until that situation changes, the paquete's popularity seems assured.

Maria Teresa, a 48-year-old from Holguin, 750 kilometres south of Havana, buys four gigabytes worth of entertainment – television series in her case – for around 20 cents.

"It's enough for the whole week," she said.

Daniel, a 22-year-old law student, told a similar story.

"In addition to films and TV series, I look for antivirus updates," he said.

Graciela, a nurse from Las Tunas, 700 kilometres from Havana, said she turned to the paquete after getting fed up with domestic entertainment.

"I watch some TV, but Cuban telenovelas are bad and the Brazilian ones take too long, it's painful. So I buy my little paquete for five pesos and I'm happy," she said.

An Easter week paquete seen by AFP bore the hallmarks of increasingly sophisticated production techniques, including advertisements for professional photography studios and small restaurants.

"I hope they don't try and ban or change them," said Marcos, a 50-year-old carpenter from Havana. "At the end of the day, all we are doing is watching peacefully at home. It's not hurting anyone."

Yet change may be inevitable.

The famous dissident Cuban blogger Yoani Sanchez plans to launch an online opposition newspaper this year.

She has said that the paper will be distributed by mobile phone and email, as well as the preferred methods of file-sharing used by Cubans – USB sticks, hard drives, DVDs and CDs.

"I hope it will appear in the paquete menus," Sanchez said.

But Pro-Castro regime blogger Yohandry predicted Sanchez's paper may prove the death knell of the paquete.

"I told my neighbours and friends to buy the paquete this week because it could be the last," Yohandry said.

Book Review – The First Muslim: The Story of Muhammad

What could be more perilous in today's religious climate than writing a book on Muhammad? We are reminded of the worldwide protests against "The Innocence of Muslims", a trashy 14-minute provocation on YouTube and a reminder to any wannabe biographer that writing a life story on the prophet is not a walk in the park.

Lesley Hazleton's "The First Muslim: The Story of Muhammad" is written by an agnostic of Jewish descent, at a time when Islam – in all its shapes and forms – is on the lips of many.

You can say that for many believers, this book would have already been passed off as an object of suspicion, perhaps another insult or parody from an author who has no business telling such a story. But there are some who would welcome such an endeavour in a more accessible form than Islamic sources, an alternative lens into a world where the funk of war is worth it to preserve the holiness of the prophet.

And bigots wanting to confirm their prejudices about "The First Muslim" will be left disappointed: Hazleton is sympathetic to her subject. This is after all the "Accidental Theologist" who blogs that she is a psychologist by training, a Middle East reporter by experience and an agnostic fascinated by the vast and often terrifying arena in which politics and religion intersect.

But perhaps it's the video of her at TED debunking pervading myths about the Quran, in particular the Orientalist "72 virgins", that's worthy of attention. She is one who dispels, not sharpens, contradictions.

The story of Muhammad is no doubt a remarkable one. It's the story of an orphaned boy who rises to become a reputed businessman and the husband of a wealthy merchant woman. This man would soon spend time in solitary meditation, which would then lead him to a revelation courtesy of the angel Gabriel – the genesis to a life as a reformer, politician and a "man of god". And he would die empowering Arabia in such a way that she would soon be a force to be reckoned with.

This is the lively plot that Hazleton captures in "The First Muslim". It's a world where theological ideas are "memes" that can go "viral", where everything has a context – from the pre-Islamic monotheistic hanifs to the Meccan trade caravan – that would shape the life of Muhammad in a radical way.

Hazleton employs a contemporary voice throughout the book, which makes it an easier read, especially if you're comparing it to other more established works on the subject from authors such as Martin Lings and Tariq Ramadhan.

But despite a bevy of sources, her work falls comfortably into the genre of pop biography. It's not scholarly stuff. Eight- and ninth-century historical material is freely mixed with speculation about Muhammad's emotions, thoughts, motives – it's pseudo-spirituality lingo where the reader is expected to "identify with him" or to "emphathise", for want of a better word.

Then there are clear signs where her prose gives in to more fictional overtures. The story of the flash flood, for example – you "flail and fall" while trying to pick yourself back up as "the roar of it is on you now." One can only wonder if Hazleton has been in such a flood or if she is paraphrasing a source. Of course, it may be excusable as a matter of style, but it works counter to the purpose of providing an account that's as accurate as possible, especially in treatments of more substantial passages.

That said, Hazleton does provide sharp observations into Muhammad's world. Although orthodox Muslims may insist that Muhammad, while prone to human failings, is irreproachable, some of his actions are troubling – to the point where even Hazleton finds difficult to shed a positive light on it. For instance, the mass beheading of the 900 surrendered men of the Qurayza, a Jewish tribe who'd become the ultimate losers in a round of factional battles for control of Medina.

And it's these points where both Muslims and non-Muslims can appreciate her work. However, Hazleton still has to attend to the question of an authentic religious revelation and whether the Quran is a text like any other or the revealed word of God. These are fascinating points to study, but Hazleton approaches them in an evasive manner, clearly hoping that she can avoid coming on the offensive. Try as she may, in our world today, that's impossible.

"Mereka mungkin menggunakan pilihan raya untuk memperbetulkan keadaan tetapi janganlah kita terlalu yakin yang mereka akan terus berlembut," katanya dalam tulisan bertajuk "Mereka yang berkuasa" di blognya www.chedet.cc hari ini.

Katanya, perkara ini tidak mustahil akan berlaku di negara ini kerana sejarah Melayu membuktikan rakyat pernah bersatu dan bertindak secara ganas menjatuhkan pemimpin zalim.

"Sultan Mahmud dibunuh walaupun tabiat orang Melayu tidak menderhaka kepada raja," katanya.

Namun menurut Dr Mahathir, senario politik negara sehingga kini masih tidak sanggup untuk menasihati pemimpin kerana takut dimarahi atau dipandang serong.

Katanya, ini kerana kebiasaannya ramai menyokong dan memuji apa sahaja yang dilakukan oleh pemimpin yang berkuasa; sama ada ikhlas menyatakan pendapat atau cuma mengangguk dan mengiakan apa sahaja yang disukai oleh yang berkuasa.

Menurut Dr Mahathir, orang sekeliling pemimpin yang sepatutnya memberi nasihat dilihat hanya membawa kesan buruk kerana tidak berani menyuarakan teguran sehingga menimbulkan kebencian rakyat.

"Tanpa teguran yang berani oleh mereka maka akan lebih buruklah prestasi pihak berkuasa.

"Kemarahan orang akan meningkat menjadi kebencian," katanya.

Bekas Menteri Kewangan, Tun Daim Zainuddin semalam menggesa Putrajaya mencari jalan untuk menyelesaikan masalah ekonomi negara dan pembangunan demi memajukan kehidupan kaum Melayu.

Beliau yang memegang jawatan itu dari 1984 hingga 1991 semasa zaman pemerintahan Dr Mahathir berkata, kerajaan perlu melakukan penyelidikan dan membetulkan semula dasar supaya ekonomi negara dapat dimajukan.

"Kerajaan sepatutnya mencari cara serta jalan penyelesaian untuk menangani masalah ekonomi di negara ini.

Menurut Daim, beliau bukanlah bukan anti-kerajaan ketika mengulas tentang kepincangan menteri kewangan dalam mentabdir urus sistem perbelanjaan negara.

"Saya bukan bermusuh dengan kerajaan, saya cuma anti dengan dasar kerajaan yang sudah lompong dan tidak betul.

"Ini isu yang serius. Rakyat harus tahu bahawa dasar yang diamalkan kerajaan tidak memberi faedah serta manfaat kepada rakyat, malah ia membebankan rakyat daripada segi peningkatan perbelanjaan ekonomi seharian," katanya seperti dilapor portal berkenaan. – 23 April, 2014.

Ketua Menteri Lim Guan Eng berkata sekalipun polis banyak membantu ketika upacara penghormatan terakhir di kediaman mendiang dari hari pertama hingga ketiga, polis tidak muncul seperti yang dirancang pada hari keempat khususnya ketika jasad Karpal Singh hendak dibawa dari kediaman ke Dewan Sri Pinang.

"Mungkin polis ada tetapi bukan seperti yang dirancang khususnya pada waktu pagi ketika jasad mendiang hendak dibawa ke Dewan Sri Pinang dan ketika ketibaan Yang Dipertua Negeri Pulau Pinang Tun Abdul Rahman Abbas dan isteri Toh Puan Majimor Shariff.

"Saya melihat tiada kawalan polis di Dewan Sri Pinang dan Tun Abdul Rahman mengalami kesusahan untuk berjalan menuju ke dewan," katanya kepada pemberita di George Town hari ini.

Beliau juga mendakwa polis tidak muncul seperti yang dirancang untuk mengawal orang ramai di luar Dewan Sri Pinang.

Kerajaan negeri hanya bergantung kepada pasukan peronda sukarela untuk membantu mengawal orang ramai yang membanjiri Dewan Sri Pinang bagi memberi penghormatan terakhir kepada Karpal Singh, katanya.

Semalam, Ketua Polis Pulau Pinang Datuk Abdul Rahim Hanafi menafikan ketiadaan polis membantu semasa upacara penghormatan terakhir kepada Karpal Singh dan menyatakan lebih 50 pegawai serta anggota bertugas sepanjang empat hari berkenaan termasuk ketika upacara pembakaran mayat ahli Parlimen Bukit Gelugor itu di Krematorium Batu Gantung, Ahad lepas.

Abdul Rahim berkata selain menjaga lalu lintas, pihaknya turut menempatkan pegawai dan anggota di rumah mendiang di Jalan Utama, di sini serta dua balai polis bergerak di pekarangan Dewan Sri Pinang ketika mayat mendiang dibawa ke situ untuk penghormatan terakhir.

Karpal Singh, 73, bersama pembantu peribadinya, Michael Cornelius, 39, maut dalam kemalangan pada 1.10 pagi di Km 306.1 Lebuhraya Utara-Selatan laluan utara berhampiran Gua Tempurung di Kampar, Khamis lepas. – Bernama, 23 April, 2014.

Legasi Harimau Jelutong

Mujahid Yusof Rawa is MP for Parit Buntar and PAS National Unity Committee chairman.

Pepatah yang menyatakan bahawa "Harimau mati meninggalkan belang, manusia mati meninggalkan nama," ada pada Karpal Singh.

Pertama, secara majazinya 'Harimau Jelutong' itu meninggalkan belang, kedua secara hakikinya mendiang meninggalkan nama yang besar sebagai ahli politik yang disegani kawan dan lawan.

Jarang seseorang dapat memenuhi perumpamaan ini secara majazi dan hakiki dalam menggambarkan ketokohan seseorang individu yang meninggalkan kita.

Singh is King

Ungkapan ini pernah dipakai oleh Karpal sesuai dengan ugutan yang diterimanya daripada Pemuda Umno.

Saya ada di dalam Parlimen semasa mendiang mempertikaikan tindakan beberapa Pemuda Umno yang cuba menghalangnya di Parlimen.

Antara ungkapan lain yang disebut oleh Karpal dalam suasana yang tegang dalam Parlimen semasa itu ialah, "Ini Pemuda Umno celaka!" lalu Yang di-Pertua Dewan Rakyat mencelah supaya ditarik balik kata-katanya itu, tetapi Karpal enggan.

Setelah didesak beberapa kali Karpal setuju dengan berkata, "Saya tarik balik, tetapi ini Pemuda Umno memang celaka".

Saat itu heboh dewan dengan ketawa daripada anggota dewan.

Karpal memang terkenal dengan perkataan berbisanya seperti "Jangan main-main..." apabila beliau ingin mendesak sesuatu tindakan diambil segera.

Dialek Indianya dalam berbahasa Melayu seringkali mencuit hati anggota dewan, tetapi isi ucapannya sentiasa mendapat perhatian pihak BN kerana sengatannya yang berbisa kepada ahli Parlimen BN.

Dewan pastinya akan sunyi selepas ini tanpa Singh is King.

Saya dan DAP

Saya mula mengenali  DAP semasa di bangku sekolah menengah lagi melalui poster pilihan raya apabila berlangsung pilihan raya umum.

Sebagai anak Pulau Pinang yang membesar di Georgetown, lambang DAP tidak menjadi sesuatu yang menakutkan saya walaupun tanggapan saya terhadap DAP semasa di bangku sekolah adalah stereotaip sama seperti budak Melayu sezaman dengan saya.

Sebagai seorang yang membesar dalam rumah pemimpin PAS, saya sukar menerima pandangan Umno apatah lagi media menyerang PAS setiap hari tetapi saya juga tidak melihat DAP mempertahankan PAS pada masa itu.

Saya boleh rumuskan semasa di bangku sekolah saya melihat DAP daripada kacamata PAS yang melihat DAP tidak banyak membantu, malah sikap 'anti-Melayu DAP' begitu mencengkam dalam benak anak muda Melayu pada zaman saya.

Namun zaman berlalu, saki-baki tanggapan kepada DAP semakin terhakis dengan kematangan berfikir generasi hari ini dan terpulang kepada sejauh mana DAP mampu membuktikan sebaliknya.

Saya yakin kemunculan politik baru Malaysia yang menolak sikap perkauman akan memudahkan lagi orang mengenali DAP.

Karpal dan saya

Jujurnya saya terlalu kerdil secara relatifnya berbanding dengan ketokohan Karpal dalam dunia politik dan perundangan Malaysia.

Bermula dari tahun 1974, Karpal memulakan karier politiknya sebagai Adun di Kedah, saya baru di tahun 4 sekolah rendah.

Nama Karpal hanya saya kenali semasa di sekolah menengah lewat persepsi saya terhadap DAP.

Semasa Kelantan memperkenalkan Undang-Undang Kanun Jenayah Syariah, Karpal antara tokoh yang lantang menentang.

Saya mula berminat untuk mengenali tokoh ini pada tahun 90-an dan cuba mencari objektif mengapa beliau menentang undang-undang hudud ini.

Daripada itu saya mula mengenali pemikiran perundangan beliau yang merupakan pengikut tegar kerangka Malaysia sebagai negara sekular.

Pertama kali bertemu

Pada tahun 2005, saya kembali ke negeri asal saya iaitu Pulau Pinang. Pertama kali saya menemui beliau ialah kunjungan semasa beliau di hospital selepas mengalami musibah.

Walaupun saya tidak sempat berbicara dengannya kerana keadaannya, tetapi saya sempat mengucapkan kata-kata semangat kepada isteri beliau bagi mewakili PAS Pusat.

Seterusnya, pertemuan saya ialah di bangunan Parlimen selepas dilantik menjadi Ahli Dewan Rakyat, kini saya bersama MP yang lain sebaris dengan MP lama, termasuklah Karpal.

Heboh Dewan hari pertama mengangkat sumpah apabila MP Kinabatangan mempertikaikan bagaimana Karpal boleh mengangkat sumpah tanpa mengangkat tangannya sedangkan wakil Kinabatangan mengetahui bahawa Karpal mengalami masalah mengangkat tangan.

Berlaku kekecohan dan itu pertama kali kami ditunjukkan bagaimana berbalas-balas kata boleh berlaku di Parlimen Malaysia.

Seterusnya pertemuan saya dengan beliau adalah sebagai ahli Parlimen muda yang cuba mempelajari selok-belok berbahas dalam Parlimen, dan saya mendapati perbahasan beliau banyak berlegar di sekitar perundangan dan kehakiman serta pendedahan beliau kepada salahlaku kehakiman yang boleh menjejaskan kredibiliti mahkamah di Malaysia.

Ucapan Karpal

Saya juga mengikuti setiap ucapan politik beliau yang sempat saya dengar. Antaranya ialah ketika saya di Melaka semasa hubungan PAS dengan DAP berasaskan kepada perjanjian Barisan Alternatif pada hujung 90-an.

Ucapannya ketika itu selamba, tetapi sarat dengan kritikan pedihnya kepada sistem perundangan negara khusus pada kemuncak kes Anwar Ibrahim.

Kemudian saya mendengar ucapannya yang lebih serius pada majlis makan malam kemenangan DAP di Pulau Pinang.

Di atas kerusi roda, beliau bersemangat menceritakan intipati perjuangan DAP dan komitmennya pada suasana demokratik dan sekular yang menjadi asas pembentukan negara ini, ucapannya serius dengan kata susun atur kalimatnya dikeluarkan satu persatu, disambut tepukan gemuruh hadirin yang masih dalam mood kegembiraan dengan kejayaan PR diterajui DAP menawan Pulau Pinang.

"Saya tidak menentang Islam"

Di sebalik tekanan tentang sikap Karpal yang dikatakan anti-hudud dan anti-negara Islam serta kenyataan kontroversinya "Langkah mayat saya dahulu...", Karpal beberapa kali menyatakan bahawa dia tidak pernah menentang Islam.

Saya sendiri ada dalam Konvensyen Pakatan Rakyat 2010 di Kepala Batas ketika Karpal di hadapan pemimpin PAS dan PKR dan para peserta konvensyen menyatakan bahawa beliau menghormati Islam sebagai agama rasmi Persekutuan yang termaktub dalam Perlembagaan Persekutuan dan beliau tidak pernah menentang Islam sebagai agama rasmi Persekutuan.
 
Karpal juga pernah menyatakan dalam satu temuramah bahawa, "I'm not opposed to Islam at all, I'm a God fearing man".

Sikap Karpal yang sering dituduh sebagai anti-Islam kerana keengganan menerima negara Islam dan hudud menjadikan beliau sebagai sasaran utama kelompok Melayu daripada kedua belah pihak Umno dan PAS atas apa juga perbezaan politik mereka.

Persoalannya ialah, mengapakah Karpal bertindak demikian?

Logik Karpal tentang hudud

Karpal adalah ahli undang-undang, hujah beliau tidak sangat menjurus kepada ideologi menentang penghayatan keagamaan, beliau lebih berminat kepada ideologi perundangan.

Hakikat ini ditegaskan dalam salah satu kenyataannya apabila ditanya mengapa beliau tidak boleh menerima konsep negara Islam dan hudud. 

Beliau menjawab, "My opposition to Islamic State and hudud is to preserve and defend the constitution..."

Memahami logik Karpal dalam hal ini ialah memahami Karpal sebagai orang perundangan dan bukan sebagai seorang yang anti-agama dan mendekati ketegasan beliau dalam hal ini juga ialah dengan menggunakan logik perundangan dan bukan sentimen dan emosi agama.

Bagi saya, tidak mudah untuk kita menuduh seseorang sebagai anti-agama Islam hanya kerana asas penolakan negara Islam dan hudud atas asas perundangan.

Ini adalah kerana bagi saya, anti-agama adalah terdorong atas kebencian dan permusuhan kepada apa sahaja makna keagamaan, termasuk menolak Islam sebagai agama rasmi Persekutuan.

Kalau begitulah logiknya, maka kewujudan Akta Mahkamah Syariah 1965 yang menghalang pelaksanaan hudud di peringkat negeri bolehkah dikatakan sebagai anti-agama Islam?

Adakah Kerajaan Persekutuan di bawah BN yang memerintah dengan perdana menterinya sebagai seorang Islam sekarang juga anti agama kerana membiarkan sekatan ini berlarutan?

Bagaimana pula seorang Islam yang menolak negara Islam dan hudud atas alasan ekonomi akan mundur dan pelabur asing akan lari malah ada yang menyatakan ianya tidak relevan lagi dalam dunia hari ini?

Saya bukan mempertahankan Karpal dan sikapnya, saya cuma mahu memberi keadilan kepada isu negara Islam dan hudud yang tidak pernah diberi gambarannya yang jelas kerana terlalu ramai yang ada kepentingan dalam hal ini sehingga ia lebih selesa ditanggap sebagai isu politik daripada isu substantif.

Logik balas

Logik perundangan juga menuntut kita untuk menjawab persoalan, apakah Malaysia sebuah negara sekular atau setengah sekular sedangkan Islam mendapat tempat yang teratas walaupun agama lain bebas diamalkan dengan sekatan tidak boleh disebarkan.

Bagaimana pula halnya senarai negeri yang antara lainnya memperuntukkan enakmen undang-undang Islam boleh digubal?

Apakah tidak undang-undang Jenayah Syariah II di Kelantan dibuat secara perundangan?

Jikalau ia dianggap ultravirus dengan Akta Mahkamah 1965, siapakah yang bertanggungjawab untuk menyemak semula peruntukan?

PAS pernah membawa bil persendirian di Parlimen melalui Presidennya Datuk Seri Hj Hadi Awang untuk isu murtad, tetapi tidak pernah diterima untuk dibahaskan.

Logik perundangan inilah yang harus dijadikan landasan meyakinkan para penggubal undang-undang bahawa akhirnya isu sensitif seperti ini perlu mendapat mandat dan proses politiknya perlu mendapat kefahaman rakyat secara substantif.

Sensitiviti isu-isu agama jika hendak diperundangkan, termasuklah hudud, pasti akan mendapat pelbagai reaksi aliran pemikiran politik namun Rashid Al Ghanushi pernah memberikan kerangka bagaimana isu ini perlu digarapkan dengan berkata:

"No one has the right to claim he represent the religion, neither An Nahda or anyone else. Society through its dynamic is the one to formulate and translate religion into policies, laws and culture... the dynamic continues untill there is concensus about the opinion of religion on the issue...

(Tidak ada sesiapa yang berhak mendakwa bahawa dialah yang mewakili agama, walaupun parti An Nahda atau sesiapa yang lain. Masyarakat melalui dinamikanya yang akan membentuk dan menterjemahkan agama kepada dasar, undang-undang dan budaya... dinamika ini berlangsungan sehinggalah adanya satu konsensus tentang sikap agama kepada isu tersebut).

Saya amat bersetuju dengan kerangka pemikiran yang demokratik digarap oleh pemimpin An Nahdah tersebut, kerana dengan kerangka ini jugalah kita harus berhujah dengan logik Karpal yang saya tahu diyakini ramai oleh rakan-rakan dalam DAP apabila isu hudud menjadi perbualan hangat sekali lagi mutakhir ini.

Karpal dan PAS

Pemimpin PAS yang sering dikaitkan bertembung dengan Karpal ialah Datuk Setia Bentara Tuan Guru Nik Abdul Aziz Nik Mat mantan Menteri Besar Kelantan.

Pertembungan mereka ialah kerana konsistennya Mursyidul Am PAS itu mahu menjalankan enakmen Jenayah Syariah yang mendapat mandat persetujuannya oleh Sultan Kelantan, tetapi terhalang kerana Akta Mahkamah Syariah (1965).

Begitulah juga konsistennya Karpal menentang hasrat ini atas hujah yang dinyatakan di atas tadi.

Namun demikian seluruh negara menyaksikan satu pertemuan bersejarah yang penuh mesra antara kedua-kedua pemimpin hebat ini di rumah Karpal apabila Mursyidul Am PAS itu menziarahi Karpal di Pulau Pinang sambil menerima kek harijadinya daripada Karpal pada 27 Jan 2013.

Kedua-duanya bertemu mesra walaupun mereka mempunyai dua pandangan yang bertentangan antara satu sama lain.

Sikap keterbukaan Tuan Guru Nik Abdul Aziz lambang komitmen PAS kepada menghormati hak untuk tidak bersetuju walaupun berada dalam satu kolusi politik.

Karpal pula sentiasa bertanggapan positif terhadap PAS daripada kata-katanya sendiri boleh membuktikan sikapnya, bahawa:

"We may have our differences with PAS, but it is a solid principled party and an important ally".

(Kita mungkin ada beberapa perbezaan pandangan dengan PAS tetapi PAS adalah parti yang berperinsip dan rakan yang penting).

Selamat tinggal selamanya

Speaker Dewan Rakyat adalah orang yang akan terasa pemergian Karpal kerana suaranya tidak akan kedengaran lagi mengetuk mikrofon meminta 'point of order' dibacakan khususnya mempertikai 'rulling' yang dibuat oleh Tuan Speaker.

Ketajamannya menimbulkan hujah perundangan dalam akta yang dibahaskan dan kritikannya kepada kehakiman di negara ini sentiasa berbisa dan pedas, namun ianya bernas.

Kami MP muda akan hilang seorang senior MP yang membuatkan kawan dan lawan ketawa dan marah ketika beliau berbahas.

Para hakim akan kehilangan peguam yang senantiasa menguji kewibawaan mereka pada tahap maksimanya.

Ahli DAP akan kehilangan suara semangat yang pernah mengatakan dalam suasana kekalahan DAP di Pulau Pinang satu ketika dahulu "Berhati-hati dengan harimau yang cedera kerana ia lebih merbahaya..."

Masyarakat sivil yang pernah mengenali Karpal tidak akan lupa kata-katanya bahawa,  "It is important for every citizen of this country to know that no one is above the law," dan kerana meyakini prinsip moral perundangan ini, beliau berhadapan dengan masalah daripada pihak istana.

Bagi seseorang yang tegas dalam dunia politik dan perundangan, Malaysia turut terasa perginya seorang anak Malaysia mempertahankan prinsip Perlembagaan Persekutuan dengan jujur.

Soal salah atau betul beliau mempertahankannya bukan isu, tetapi itulah caranya beliau melahirkan kasihnya pada negara yang tercinta ini.

Sepi seketika hiruk-pikuk suara yang menghentam Harimau Jelutong ini pada awal pagi berita kematiannya secara tragis di maklumkan seluruh negara.

Harimau tidak mengaum lagi tetapi belangnya meninggalkan bekas seperti namanya. Kata-kata mendiang akan sentiasa teriang di telinga kawan dan lawannya, "You knock out one Karpal Singh, hundreds of Karpal will rise".

Bounty for finding MH370

Rushdi believes that a change agent must tell the truth to a benevolent dictator, religious hardliner, and compassionately connect with youth and have nots.

Today marks the 47th day since the disappearance of flight MH370 headed for Beijing from Kuala Lumpur.

As each day passes without any trace and clues on the whereabouts of MH370, the families continue to cling on to hope and pray for a divine miracle, but also understand the remote chances of finding their loved ones alive.

If there is a "hell on earth", it surely must be what these brave families are encountering.

The search has been "narrowed" to the southern arc flight path in one of the most inhospitable parts of the world, the Indian Ocean, some 2,000km from Perth. Australia.

The "mini-submarine", Bluefin-21, after nine deep dives (4,000 meters), covering approximately 66% of the intended area, has yet to find traces of MH370.

The interest of all concerned is locating the (now non-pinging) black boxes and plane, hence, the "public sector" search approach (which, according to some, has become expensive) needs to supplemented by the more entrepreneurial private sector. The caveat is there must be cooperation and coordination, especially at this stage.

Does it matter who finds the plane/black box?

Lawyers

For many, in certain cultures, lawyers are the un-necessary evil, but they do serve a purpose; not right a wrong, but bring monetary compensation to victims minus their contingent fees (bounty).

"Lawyers were notorious for finding cases in the most unlikely places, especially ones with huge potential damages awards." (Jodi Picoult, Handle With Care)

They also move companies from their heels to their toes, which, at times, is not a bad development from a public service point.

Thus, it was inevitable that American lawyers would "officially" parachute in after the 45-day rule (in the United States) to reach out to the grieving families to commence filing suits against Boeing Corporation (need to find MH370, first) and Malaysia Airlines.

The nuances, complexities and details of the suit against the plane manufacturer and the airline are for others to e-pen about.

Bounties

As stated above, lawyers have a financial incentive to inject themselves into this tragedy, much like they did in Bhopal (Union Carbide), Lockerbie (Pan Am), Air France flight 447 crash into the Atlantic, and so on.

But, do the passenger families have incentive for involving the private sector in the search mission?

(The private sector has same incentive as the lawyers, monetary incentive [bounty] and ensuing publicity, for being involved.)

At this point, the families are less concerned about the various theories, conspiracy or otherwise, and just want answers and/or closure so they can move on.

Furthermore, the authorities are in a similar position of wanting to move forward, be it answers or closure.

It may come across as unsavoury to inject the concept of "bounty" into such a tragedy, but the objective is to get answers/closure.

Bounties have been used in a variety of matters:

Reward for capture and/or killing of murders, especially cop killers;

Reward for capture and/or killing of extremists;

Reward for whistle-blowers, percentage of recovery in cases where there is financial fraud against government contracts;

Reward for reduced sentences and witness protection programmes in cases of testifying against co-defendants;

Reality programmes on "Bounty Hunters".

Now, who would offer the bounty for finding MH370?

It could Boeing Corporation, but would that be assisting the lawyers in finding the evidence?

It could Malaysia Airlines to exculpate itself from fault.

It could governments involved in the search, led by China and Malaysia, as may be more cost effective in the medium term.

It could be passenger families by way of a fund-raising.

It could be concerned multi-millionaires/billionaires, who believe it's the best use of part of their wealth (giving back).

It could be the lawyers pursuing the case.

Inevitable

It may be MH370 is found at the deepest canyons of the Indian Ocean, hence, like the Titanic, it will be the final resting place for all to pay respect.

It is inevitable that families of MH370 will become a larger family unit united by common tragedy. I hope the lawyers (or others) do not take away from the goodwill the families have towards each other by enticement of monetary gains, beyond what is allowed by international protocols on such matters.

It is inevitable that a Hollywood movie on MH370 will be made after there is closure. Let's hope the families receive some royalty if/when the movie is made.

It is inevitable that planes will have multiple tracking devices that cannot be disengaged without alarms going off.

It is inevitable the authorities have learned lessons on how best to share information with the families and media.

Conclusion

All of us have encountered deaths in our families, sudden or illness induced, and the following quote from Gilda Radner may be appropriate:

"While we have the gift of life, it seems to me the only tragedy is to allow part of us to die – whether it is our spirit, our creativity or our glorious uniqueness."

I pray answers and closure is around the corner for the brave families of MH370. – April 23, 2014.
